These Service Agreement & Terms and Conditions ("Agreement") apply to moving labour and related services provided by Your Choice Moving Labour ("YCML," "we," "us," or "our").
By checking the acceptance box and completing a booking, the customer ("Customer," "you," or "your") confirms that they have read, understood and agreed to this Agreement and that the information supplied with the booking is accurate and complete.
YCML is primarily a moving labour service. Unless specifically stated in the confirmed booking, YCML does not provide the moving truck, rental vehicle, trailer, portable storage container, shipping container, storage unit or transportation of the Customer's property. Depending on the service booked, YCML may provide:
The Customer is responsible for arranging transportation, containers, storage facilities and other third-party services required for the move unless YCML expressly agrees otherwise.
The Customer must provide accurate and reasonably complete information about the job, including addresses; type of service; amount of property; truck/container size; stairs; elevators; walking distances; parking; loading docks; access restrictions; heavy or oversized items; appliances; fragile items; disassembly/assembly; building restrictions; and other conditions materially affecting the work. YCML pricing, crew recommendations and estimated duration may rely on this information. If actual conditions materially differ, additional labour, time, workers or charges may be required. YCML may refuse work that was materially misrepresented or cannot reasonably or safely be completed.
The minimum service time displayed during checkout applies to the booking. Unless the confirmed booking specifies otherwise: 2 movers — 2-hour minimum; 3 or more movers — 3-hour minimum. The minimum charge remains payable even when work is completed sooner. After the applicable minimum, additional labour is charged using the rate and billing increment displayed with the booking. The rates and minimums shown in the final booking confirmation govern that job.
Any recommended or estimated duration is an estimate and is not a guaranteed completion time or fixed-price quote unless expressly identified as fixed-price. Moving time can be affected by volume, packing readiness, stairs, elevators, walking distances, parking, truck/container size, weather, building access, disassembly/assembly, heavy items, customer delays, and undisclosed conditions. For hourly services, the Customer is responsible for actual billable time subject to the applicable minimum.
Unless otherwise stated, billable time begins when the YCML crew arrives at the scheduled job location and is ready to begin. Billable time ends when requested work is completed, the Customer releases the crew, or YCML properly ends the job under this Agreement. Customer-controlled waiting time may remain billable, including waiting for the Customer, keys, building access, elevators, loading docks, trucks, containers, property managers, other contractors, or Customer decisions concerning placement of belongings.
YCML makes reasonable efforts to arrive at the scheduled time. Traffic, weather, road conditions, previous jobs, emergencies and circumstances outside YCML's reasonable control can occasionally cause delays. YCML will make reasonable efforts to notify the Customer of significant delays. A reasonable delay does not automatically constitute cancellation.
When the Customer supplies or rents a truck, trailer, portable storage container, shipping container or similar equipment, the Customer is responsible for obtaining it and ensuring it is reasonably safe, suitable and available. The Customer is responsible for selecting its size. YCML cannot guarantee that all belongings will fit. YCML crews may recommend loading arrangements using their professional judgment, but available capacity depends on the vehicle/container, belongings and packing. Unless expressly agreed otherwise, YCML is not responsible for rental charges, fuel, mileage, late fees, transportation charges, storage fees or other third-party expenses.
Unless expressly included in the confirmed booking, YCML does not transport Customer property between locations. Where YCML only loads a vehicle or container, YCML's physical custody and control ends when its loading service is completed. YCML is not responsible for events occurring during subsequent transportation, towing, storage or third-party handling except to the extent required by applicable law.
Unless packing services were booked, the Customer is responsible for having belongings appropriately packed and reasonably ready to move. Boxes should be closed securely and capable of supporting their contents. Fragile items should be appropriately protected. YCML may decline to move an inadequately packed item if doing so creates an unreasonable risk. If YCML identifies an unusual packing risk, the crew may recommend corrective action before proceeding.
YCML crews may use appropriate available moving equipment and protection, including dollies, straps, tools, shrink wrap, floor runners and door protection. Moving blankets are normally supplied with or obtained for the Customer's rental vehicle/container unless specifically arranged otherwise. The Customer should ensure adequate suitable moving blankets are available. Where adequate protection is unavailable, YCML may recommend additional protection or decline to load particular property where the risk is unreasonable.
Customers, friends or family may assist unless YCML determines that their participation creates a safety or operational concern. Anyone assisting must follow reasonable crew safety directions. YCML is not responsible for damage or injury caused by persons outside YCML's crew except to the extent required by law.
Children and pets must be kept away from active moving areas, pathways, ramps, equipment and vehicles. YCML may pause work where they create unsafe conditions. Customer-caused waiting time may remain billable.
The Customer must provide reasonably safe access, including safe stairs, clear walkways, adequate lighting, accessible entrances, reasonable parking, structurally safe floors/decks/stairs, snow and ice removal, controlled pets, and disclosure of known hazards. YCML may refuse, pause or discontinue work where conditions are reasonably considered unsafe.
Services may proceed during ordinary weather when work can reasonably be performed safely. YCML may delay, pause, reschedule or discontinue work where weather or site conditions create an unreasonable safety risk.
Customers must disclose unusually heavy, oversized, awkward or specialty items before booking, including safes, pianos, commercial equipment, oversized appliances, exercise equipment, stone/concrete items, and exceptionally large furniture. Additional movers, charges, preparation or specialized equipment may be required. YCML may decline an item that cannot reasonably be moved safely. Failure to disclose a specialty item does not require YCML to move it.
YCML may assist with ordinary furniture disassembly and assembly when reasonably possible. YCML may decline items that are unsafe, unusually complicated, damaged or improperly installed. Particleboard, pressboard, flat-pack and previously damaged furniture can deteriorate during disassembly, moving and reassembly because of their construction and condition.
The Customer is responsible for preparing appliances unless otherwise specifically arranged, including disconnecting water, gas or hardwired electrical connections, draining appliances and securing internal components. YCML movers are not licensed plumbers, gas technicians or electricians unless expressly stated otherwise. YCML may refuse work requiring a licensed trade.
YCML may refuse illegal, unsafe, hazardous or unsuitable property, including explosives, dangerous flammable materials, leaking chemicals, hazardous substances, illegal goods, unsecured firearms/ammunition, biological hazards, unsafe pressurized containers, live animals, or anything creating an unreasonable safety risk. Potential hazards must be disclosed before work begins.
Customers should personally transport money, jewellery, passports, important documents, medication, keys, electronic data, collectibles and small high-value or irreplaceable items whenever reasonably possible. Exceptionally valuable, fragile or irreplaceable property should be disclosed before YCML handles it.
YCML is not responsible for damage existing before YCML handled an item or entered the property, including weakened furniture, loose joints, deteriorated particleboard, previous repairs, cracked glass, unstable furniture, existing wall/floor damage, defective appliances, or structural defects. YCML may photograph/document pre-existing conditions.
Moving property involves inherent risks despite reasonable care. Limited clearance, unusually large dimensions, fragile construction, previous damage, inadequate packing and difficult access increase those risks. YCML will perform its services with reasonable care and skill. Nothing in this Agreement removes statutory rights or remedies that cannot legally be waived.
Where YCML loads but does not transport the shipment, YCML is not responsible for damage caused after its work is completed by vehicle movement, road conditions, accidents, shifting during transit, driving, subsequent rearranging, third-party handling, storage conditions, water intrusion into Customer-provided equipment, or defects in Customer-provided transportation/container equipment, except where applicable law establishes responsibility arising from YCML's own contracted work.
Customers should inspect property as soon as reasonably possible. Suspected YCML-related damage should be reported promptly with available photographs, description, item information, approximate age, proof of value where available, and relevant pre-move photographs. Prompt reporting helps YCML investigate. Nothing in this provision shortens any statutory limitation period that cannot legally be shortened.
Reporting damage does not automatically establish responsibility. YCML may investigate pre-existing condition, packing, handling, loading, transportation, access, photographs, crew statements, Customer statements, and subsequent handling. Resolution depends upon the facts, applicable law and any separate protection/valuation terms legally forming part of the booking.
YCML is not required to force property through a doorway, hallway, stairway, elevator or other opening. Crews may stop where there is a material risk of injury or damage. YCML does not remove structural components, windows, doors or railings unless specifically agreed and considered safe.
YCML will reasonably follow Customer instructions. Crews may refuse instructions that are unsafe, illegal or create unreasonable risk. The Customer cannot require a worker to perform unsafe work simply by agreeing to assume the risk.
Customers may request additional work during a job. Additional work depends upon crew availability, safety, subsequent scheduled commitments, applicable rates, and any additional charges disclosed before the additional work is undertaken. A booking does not guarantee unlimited crew availability.
Applicable travel charges, service-area charges, specialty charges, surcharges, taxes or other fees must be disclosed through the booking process or authorized before being charged, except additional hourly labour arising from actual job duration under an hourly booking.
The Customer agrees to pay the charges associated with the booking. Applicable deposit/payment terms will be displayed at checkout. Unless otherwise stated, any remaining balance is due upon completion. The Customer authorizes YCML and its payment processor to charge the approved payment method for legitimate amounts due under the booking, including actual hourly labour calculated using the agreed rate and billing increment. YCML will not add undisclosed optional charges without authorization.
If an authorized payment fails, legitimate outstanding charges remain payable. YCML may request another accepted payment method.
Tips are optional and never required. Where tipping is offered, tips are intended for the workers performing the service and are handled according to YCML's applicable procedure.
The cancellation/rescheduling policy displayed before booking forms part of this Agreement. YCML encourages rescheduling where circumstances change. Any cancellation charge, deposit retention or refund will follow the policy disclosed before purchase and applicable consumer law. YCML may make reasonable exceptions in exceptional circumstances.
YCML may cancel, delay or reschedule because of severe weather, unsafe conditions, worker illness/emergency, travel emergencies, materially inaccurate booking information, abusive/threatening conduct, illegal activity, or circumstances outside reasonable control. Where YCML cancels and cannot reasonably provide an alternative service date, amounts paid for services not provided will be handled/refunded as required by applicable law.
YCML workers are entitled to a safe and respectful workplace. YCML may stop service because of threats, harassment, violence, discriminatory abuse, sexual harassment, dangerous conduct, illegal activity or serious misconduct. Legitimate charges for services already performed remain payable to the extent permitted by law.
The crew lead may make reasonable on-site safety decisions, including refusing unsafe lifts, equipment, access or instructions.
Rental companies, storage facilities, property managers, building staff and other outside businesses are independent from YCML unless expressly stated otherwise. YCML is not responsible for their independent acts, omissions, equipment, policies or charges except where required by law.
YCML determines the personnel assigned to each booked service. Services may be performed by YCML employees and/or independent contractors, operators or service providers engaged through YCML ("Service Providers"), depending upon location, availability, job requirements and operational needs. Personnel performing work through a YCML booking are expected to follow YCML's applicable service, safety and customer-service standards. The Customer contracts with YCML for the booked service and does not separately select, hire or enter into an employment relationship with individual crew members solely because those individuals perform work on the Customer's job. YCML remains responsible for administering the Customer booking, including scheduling, customer communication, applicable charges and payment processing, subject to this Agreement. The Customer must not make separate arrangements with a crew member that materially change the scope, price or terms of the YCML booking unless authorized by YCML. Nothing in this Agreement determines or alters the legal employment or independent-contractor status of an individual Service Provider. Status is determined by the actual working relationship and applicable law.
YCML may reasonably photograph/document belongings, loads, access, pre-existing damage, completed loading, safety concerns, and damage claims for operational, training, quality-control, insurance, dispute-resolution or recordkeeping purposes. Identifiable images of Customers or private residential interiors should not be publicly used for marketing without appropriate permission.
YCML may collect information reasonably necessary to quote, schedule, perform, communicate about and receive payment for services. Information may be shared with service providers where reasonably necessary to perform the booking, process payment, operate YCML systems or satisfy legal requirements. Payment-card information should be processed/stored through the applicable secure payment processor rather than unnecessarily stored directly by YCML. YCML's Privacy Policy applies where applicable.
YCML may send transactional communications regarding the booking by email, text or telephone, including confirmations, reminders, scheduling, arrival updates, payment information, receipts, service follow-up, and review/feedback requests where legally permitted. Marketing communications remain subject to applicable consent requirements.
Checking the acceptance box and completing the booking constitutes electronic acceptance of this Agreement. YCML should retain an electronic record of the version accepted with each booking. The Customer should receive the booking confirmation and durable access to the applicable Agreement.
Before confirmation, the applicable Customer details, location, service date, exact arrival time, service, crew size, hours selected/estimated, minimum, rate, travel charge, additional disclosed charges, taxes, deposit/current payment, remaining balance/calculation method, cancellation/rescheduling policy, and current total authorization are displayed. The Customer must have an opportunity to review and correct information before purchase.
To the maximum extent permitted by law, YCML is not responsible for indirect, incidental, special or consequential losses such as lost profits, lost income, loss of use, missed appointments or unrelated third-party expenses arising from the service. Nothing in this Agreement excludes liability that cannot legally be excluded or removes statutory consumer rights.
To the extent permitted by law, the Customer is responsible for losses or expenses caused by their unlawful conduct, undisclosed hazards, materially inaccurate booking information or persons under their control. This does not transfer to the Customer liability that applicable law places upon YCML.
YCML is not responsible for delays or inability to perform caused by circumstances outside reasonable control, including severe weather, natural disasters, road closures, government restrictions or major utility failures. YCML will make reasonable efforts to communicate and reschedule affected services.
This Agreement is governed by the laws of Nova Scotia and applicable laws of Canada. Nothing in this Agreement prevents a Customer from exercising applicable statutory consumer rights.
If a provision is invalid or unenforceable, it should be limited or removed only to the extent required, while the remaining provisions continue.
The Customer's booking confirmation, disclosed pricing, cancellation/rescheduling policy, these Terms and Conditions, and written modifications agreed by YCML and the Customer collectively form the agreement governing the booked service.
YCML may update these Terms for future bookings. Changes must not silently retroactively replace the terms accepted for an existing booking. The version accepted with each booking must remain recorded.
By accepting these Terms, the Customer confirms that: booking information is accurate to the best of their knowledge; they understand YCML primarily provides moving labour rather than transportation; they understand their rate and minimum booking time; they understand estimated hours are not guaranteed completion times; they have disclosed stairs, access issues, heavy/specialty items and other material conditions; they understand their responsibilities concerning trucks, containers, packing and access; they have reviewed the cancellation/rescheduling policy; they authorize payment according to their booking and these Terms; and they had an opportunity to review the booking and Agreement before purchasing.

You may reschedule or cancel your booking from your customer portal or by contacting YCML. This policy forms part of the YCML Service Agreement & Terms and Conditions.
Bookings must be made at least 24 hours in advance of the scheduled start time.
YCML may make reasonable exceptions in exceptional circumstances. If YCML cancels and cannot reasonably provide an alternative service date, amounts paid for services not provided will be handled or refunded as required by applicable law.
